CM, L-G head for DCW Secretary appointment (Relevant for GS Mains Paper II, Topic: Differences between CM and LG in Delhi)

Delhi Chief Minister Arvind Kejriwal has termed the appointment of Alka Diwan as member secretary of the Delhi Commission for Women ‘unconstitutional’. Mr. Kejriwal has recommended immediate withdrawal of the appointment of Ms. Diwan, who is also serving as VAT Commissioner, calling it null and void.

In his note, Mr. Kejriwal said the elected government has to nominate the member secretary but the L-G went ahead without informing it.

The government had already nominated a certain name and without considering it, Ms. Diwan was nominated.

The CM’s recommendation comes following a representation sent to him by DCW chief Swati Maliwal alleging that the appointment has led to stalling of the functioning of the Commission and subverting its autonomy.

Ms. Maliwal claimed that all files were routed by Ms. Diwan to the Delhi government’s Women and Child Development Department. “The autonomy of DCW is under attack. We can’t take any decision involving finance,” she had said. Ms. Maliwal said the DCW will find it difficult to run its mobile helplines and the rape crisis cell as the member secretary has allegedly stopped releasing salaries of the contractual staff for the past three months.
